We legally accompany survivors of torture

Case of Alfredo
 
He is originally from Tabasco, Mexico; he was illegally detained by the Chiapas police and charged with kidnapping in June 2014.
 
Since 2017, Frayba has fully accompanied Alfredo and his family; In coordination with independent expert witnesses, the Istanbul protocol was applied through which all the illegal evidence offered by the prosecution was demonstrated.
 
On January 20, he was sentenced to 50 years in prison despite the fact that on January 19, as the Frayba Bartolomé de Las Casas Human Rights Center, we went to the criminal court of the state of Chiapas in the municipality of Pichucalco, to dialogue with the corresponding authorities. making the subject of Alfredo visible to the judge, I argue that the principles of presumption of innocence and the principle of exclusion of means of evidence will be applied, due to the acts of torture committed against him proven after the application of the Istanbul protocol, which dismissed accusatory elements against him. That is to say, with the Istanbul protocol applied by the Frayba through independent experts in the matter, his illegal detention was demonstrated, and the torture that made his self-incrimination possible, for which the evidence that the Chiapas Prosecutor's Office has provided to convict him they are illegal.

Case of Huasín
 
Originally from Tabasco, Mexico, illegally detained in 2011 accused of kidnapping, and subjected to acts of torture in the process of his arrest. From the Centro de Derechos Humanos Fray Bartolomé de Las Casas we offer comprehensive support. Together with independent expert witnesses, the Istanbul protocol was applied to him, demonstrating his illegal detention and torture.
 
On January 19, we were present at the Chiapas criminal court in the municipality of Pichucalco, Chiapas, Mexico, arguing that the Istanbul protocol be considered as evidence in the criminal trial. We are waiting for the protocol ratification hearing to take place, waiting for the principle of presumption of innocence and exclusion of evidence to be applied, which would mean that the justice authorities would be left without evidence to support the accusation. against Huasín, since they were obtained illegally through human rights violations, from illegal detention, torture, as well as the statement in which he is accused.

Case of Yonny
 
He is detained in the jail of Chiapas, accused of homicide and aggravated robbery; He has been illegally deprived of his freedom for 2 years and 10 months and unjustly sentenced to 33 years in prison. At Frayba we have assumed his legal representation and defense. In January, the oral trial hearing was proposed in which his legal situation will be defined, that is, his innocence or guilt of the crimes imputed to him would be defined.
 
The first hearing was scheduled for January 5, 2022, which was suspended 24 hours before taking place because the Chiapas State Prosecutor's Office was delayed in the formal proceedings with the co-defendant's defense. A second hearing was scheduled for January 21, in which once again the Frayba team of lawyers went to the jail in Villaflores, along with Yonny's family and members of the United Families Against Torture group, offering solidarity to him and his family outside the courthouse. Moments before the hearing began, they announced that it would be suspended again for biosafety reasons, extending the date of the hearing to February 4. At the same time, in an act of advocacy and solidarity, members of the United Families Against Torture group accompanied Yonny's family to show their support, holding a press conference where they made known their position of solidarity and the demand towards the court. to issue an acquittal.

The guilty factory continues in Chiapas
 
Luis is 27 years old, he is originally from Chiapas, Mexico, and works as a builder. He was arbitrarily detained at his home on July 28, 2021. At the time of detention he was tortured.
 
For 5 hours he was missing, that was the time he was held performing acts of torture, and immediately transferred to the jail of the municipality of Villaflores and accused of the crime of damage to health. In the initial hearing, Luis disclosed the torture suffered at the time of his arrest, corroborated in the report of the doctor attached to the justice authorities. For this crime on December 9, 2021, Luis was acquitted.
 
On August 31, 2021, the Chiapas authorities arrested Luis again for the crime of aggravated homicide through the falsification of testimonies, as well as theft and falsification of his identity. Despite having illicit evidence, the criminal process against him continued, allowing bad practices in the investigation.
 
Violations of due process, the presumption of innocence, freedom and personal integrity, among others, represent a criminal action against the population and a criminal investigation policy that constitutes the installation of a factory of crimes and culprits.
