Introduction
As we reach the conclusion of another impactful quarter at Lawyers for Human Rights (LHR), it is with immense pride that we reflect on our unwavering commitment to defending the rights of vulnerable populations, particularly those affected by statelessness.
Legal Advocacy Progress
Our strategic focus has intensified around addressing the systemic failures of the Department of Home Affairs (DHA) to implement the South African Citizenship Act. Notably, we filed two pivotal cases in the Pretoria High Court that address significant issues of statelessness, focusing on ensuring citizenship access for children born in South Africa to refugee, asylum-seeking, migrant, or stateless parents, and addressing the DHA's refusal to register certain individuals as South African citizens, leaving them stateless. This case is part of our stratic feminist litigation strategy to develop jurisprudence enhacing protections for women affected by statelessness in South Africa.
DNA Testing and Citizenship Applications
We have facilitated DNA tests crucial for citizenship applications, enhancing our capacity to advocate for clients seeking the right to identity and nationality. These tests are a critical step in ensuring that individuals have access to their citizenship rights, and we will continue to support this effort in the coming months. We managed to complete 5 DNA in the reporting period and have 4 planned for the first quarter of 2025.
Continued Challenges and Response
In response to ongoing challenges related to the Department of Home Affairs (DHA), Lawyers for Human Rights (LHR) is actively working on the enforcement of the Pretoria High Court's ruling from 18 September 2024, which ordered the DHA to unblock the identity documents of 142 LHR clients within 20 days. This judgment followed the DHA's continued non-compliance with an earlier court order in the Mazibuko case, handed down in January 2024, which confirmed the unconstitutionality of the DHA’s practices. Many individuals remain unable to access essential services and their constitutional rights are being compromised due to these blockages. Alongside our enforcement efforts, we have also launched a second case in response to a Notice published by the DHA on 16 August 2024, which threatens to cancel the IDs of individuals without due process. While the court ruled that this notice does not apply to LHR’s clients, it poses significant risk for thousands of others. LHR is currently negotiating a settlement related to this notice to ensure that affected individuals are not adversely impacted, safeguarding their rights and access to identity documents.
Awareness and Advocacy Initiatives
Our engagement has included numerous key events focused on raising awareness about statelessness, including participation in a webinar hosted by international partners, representation at the World Conference on Statelessness, attendance at the African Committee of Experts on the Rights and Welfare of the Child session, and participation in the ID4Africa conference.
As part of our efforts, we hosted a panel addressing ID blocking in the digital age during the annual Public Interest Law Gathering conference.
Multimedia Campaign and Upcoming Plans
We are also excited to announce the successful design of a multimedia campaign that narrates the stories of women living with statelessness. This campaign is also part of our feminist advocacy and litigation strategy aimed at enhancing the protections for women facing statelessness.
As we move forward, our focus remains on advancing reforms to the South African Citizenship Act to guarantee state recognition for every child born in South Africa.
